Georgia CANNABIS BUSINESS LICENSE
Georgia offers limited opportunities for cannabis business licenses under strict regulations for low-THC (0.5% or less) medical cannabis and hemp (0.3% or less THC). Managed by the Georgia Access to Medical Cannabis Commission (GMCC) and the Georgia Department of Agriculture (GDA), the state’s cannabis industry focuses on medical low-THC oil and hemp cultivation. Application availability varies by license type. Below, we outline the current status of Georgia cannabis license applications for medical cannabis and hemp businesses.
Georgia’s medical cannabis program, established under the Hope Act (2019), regulates licenses for producing and dispensing low-THC oil. Adult-use cannabis remains illegal, limiting opportunities to medical use only.
Current Status: 14 dispensaries operational as of May 2025, with applications ongoing due to patient registry growth (over 27,000 patients).

ADHS is not currently accepting new applications for Marijuana Establishment Licenses or non-profit dispensary certificates. Arizona’s 143-169 licenses are fully allocated, with the last window in December 2022. New windows may open if ADHS increases the license cap or revokes non-compliant licenses. Different states require certain team structures on your state license application. Regardless of the state requirements, there are a number of considerations to structuring your team, including state residency, ownership restrictions, past cannabis experience, and more.
Prior to obtaining a license you will need to secure property that is zoned correctly and able to support the needs of a cannabis business. This can, at times, be the most challenging part of the process.
Our team has worked with countless municipalities to assist our clients in obtaining compliant properties in correctly zoned areas, so we know how challenging this can be. You may be required to present to your mayor, city council, zoning board, and variance board. If you do not secure municipal cannabis business license approval, you will not be able to win a state cannabis business license.
Application requirements vary between Standard Operating Procedures (SOPs) and narrative forms surrounding the expectations you have for your business. Either way, these need to be compliant with all state, local, and federal regulations. Ensuring that you are compliant is one of the most important steps in the application process. Beyond the application, once operational, your SOPs will be the heartbeat of your organization and your ability to keep your license.
