Current Status: Applications Closed

The Virginia Cannabis Control Authority (CCA) oversees the medical cannabis program, issuing Pharmaceutical Processor Permits for vertically integrated operations (cultivation, manufacturing, and dispensing) across five Health Service Areas (HSAs).

  • HSA 1 Permit Awarded: The latest application window for HSA 1 (northwestern Virginia) closed in April 2024. The CCA granted conditional approval to AYR Virginia.
  • Availability: All five permits have been allocated or are in the final approval process. No new RFAs are currently open.

Application Process

When an RFA is announced, the process includes:

  • Eligibility: Open to individuals or entities; prior cannabis convictions are not disqualifying, supporting social equity goals.
  • Required Materials:
    • Detailed business plan (cultivation, manufacturing, and dispensing).
    • Financial statements proving economic stability.
    • Facility blueprints and security plans.
    • Community impact plan emphasizing social equity.
  • Fees: A non-refundable $18,000 application fee. Upon approval, a $165,000 initial permit fee is required, with a $132,000 annual renewal fee (per 3VAC10-20-30).

Note: Existing medical processors seeking “dual-use” privileges for adult-use retail should prepare for a $10 million conversion fee. Under the current bill, this fee may be paid over a three-year installment plan to facilitate the transition.

Adult-Use Cannabis Licenses

Current Status: Legislation Pending Governor’s Action

Following the 2025 gubernatorial election, Virginia’s path to retail sales has moved into a critical final stage. The General Assembly passed HB 642 and SB 542 in early 2026 to establish a commercial market. As of April 2026, the legislation is back on Governor Abigail Spanberger’s desk after a high-profile legislative stalemate.

  • Future Outlook: On April 22, 2026, the General Assembly rejected the Governor’s proposed amendments to delay the market until July 2027 and reduce license caps. Lawmakers are holding firm on a January 1, 2027, start date. The industry is currently awaiting the Governor’s final decision to either sign the bill or issue a veto. The deadline for this decision is May 22, 2026.
  • Regulatory Efforts: The CCA continues to draft the operational framework. While possession and home cultivation are legal, retail sales cannot begin without the Governor’s signature on the current legislation.

Adult-Use Cannabis License Types

Under the current legislation (HB 642 / SB 542), planned licenses include:

  • Cannabis Retail License: Up to 350 available (Legislature rejected a drop to 200)
  • Cannabis Cultivation License: 450 available (Class A and Class B)
  • Cannabis Product Manufacturing License: 60 available
  • Cannabis Wholesale License: 25 available
  • Testing and Transport Licenses: Details forthcoming


Application Process

When applications open, the process will involve:

  • Eligibility: Open to those 21+. “Impact Licensees” (social equity applicants) receive priority waves for licensing. This includes individuals with prior cannabis convictions, residents of disproportionately impacted areas, or Virginia HBCU graduates.
  • Required Materials:
    • Comprehensive business and security plans.
    • Financial statements and proof of funding.
    • Labor Peace Agreement: A signed commitment to neutrality with workers is a mandatory regulatory requirement.
    • Zoning compliance documentation.
  • Fees & Support: Standard license fees are TBD, though social equity applicants are expected to receive significant fee waivers. Additionally, HB 642 establishes a Cannabis Equity Business Loan Fund to provide low-interest capital to eligible applicants.

  • Priority Access: Social equity applicants receive priority processing and specialized support.
  • Reinvestment: The legislature intends for revenue to fund the Cannabis Equity Reinvestment Fund, supporting communities historically impacted by cannabis prohibition.
  • Support: The Cannabis Business Equity and Diversity Support Team provides technical assistance to navigating the application process.

  • Home Cultivation: No license is needed for personal cultivation (up to four plants per household for adults 21+); plants must be tagged and out of public view.
  • Legislative Risks: Retail sales depend on the final enactment of current bills. A veto would push the timeline into the 2027 legislative session.
