Nebraska Medical Cannabis Rules Are Live: What Operators Need to Know

It’s official. Nebraska just dropped its first real set of medical cannabis rules… and they’re live now. 🌱 

As of July 1, 2025, the Nebraska Medical Cannabis Commission (NMCC) put emergency regulations into effect. They’re only temporary (90 days), but they finally give potential operators something to work with.

Whether you’re already planning a play in this market or just starting to watch closely, here’s what these new rules actually mean – and how to position yourself before the next window opens.

1. What This Program Actually Covers

Let’s start with the basics of Nebraska medical cannabis regulations:

  • Medical use only. Patients must qualify under a state-approved list of conditions.
  • No adult-use. Recreational cannabis is still off the table.
  • Only 12 dispensary licenses. One per judicial district. “You’re saying Omaha and Lincoln only get one storefront each” ?  Yep.

If you’re going after a license, expect it to be competitive. But that also means the field is small, and if you’re prepared, the opportunity is very real.

2. Products Are Limited… and So Is Real Estate

Here’s what you won’t see on the shelves at launch:

  • 🚭No flower
  • 🚫No vapes
  • 🚫No edibles
  • 🚫No flavored products

The state is only allowing capsules, tinctures, and topicals for now.  So your business plan needs to reflect that.

As for your storefront or facility, Nebraska has a 1,000-foot buffer rule. That means you’ll need to stay at least 1,000 feet away from schools, daycares, churches, or hospitals. That narrows your location options fast, so pull out a zoning map before you fall in love with a property.

3. The Rollout Isn’t Without Controversy

This is still a new and evolving Nebraska medical cannabis market — and not everyone’s aligned.

  • The Attorney General has already threatened legal action if licensing moves forward.
  • Lawmakers are worried about a “Wild West” rollout and want to avoid corporate monopolies.

Translation: more changes could be coming. But if you’re paying attention now, you’ll be ready to pivot later — and that gives you the edge.

4. What You Can Start Doing Right Now

This is the part most people overlook, but it can make all the difference. You don’t need to wait to take action.

✅ Draft your SOPs

Inventory control. Security plans. Diversion prevention. These documents will be required, and solid SOPs are often what set winning applications apart.

✅ Get your financials in order

Nebraska will prioritize applicants with capital, clean funding, and realistic pro formas. Start organizing now so you’re not scrambling later.

✅ Build local relationships

Introduce yourself to community leaders, law enforcement, or local stakeholders. It builds trust, and helps you when it’s time to site a property or get zoning approval.

5. Taxes, Fees, and What Comes Next

We don’t have final numbers yet, but early signs point to:

  • Application fees in the $25,000 – $100,000 range
  • Annual license renewals around $5,000–$25,000
  • The state is proposing a 4% sales tax

If that changes, we’ll update you. For now, build your budget with a cushion, then adjust when official numbers drop later this fall.
