    • Furthermore, House Bill 413, titled the “Marijuana Legalization and Reinvestment Act,” was introduced in the 2025-2026 legislative session. This bill aims to legalize and regulate the sale, possession, and use of cannabis in North Carolina.

Tribal Jurisdiction: Eastern Band of Cherokee Indians (EBCI)

  • Legalization on Tribal Land: In September 2023, the EBCI approved an ordinance permitting the recreational sale and use of marijuana for adults on their land. This decision followed a referendum where 70% of tribe members supported adult recreational use. The ordinance also decriminalizes cannabis within the Qualla Boundary but imposes restrictions on where it can be consumed, with penalties for violations.
